This Privacy Policy describes how Vivrelle, LLC and its affiliates (“Vivrelle,” “we,” or “us”) collects, uses, discloses and otherwise processes information about you. This Privacy Policy applies to information we collect when you access or use our website (the “Website”), our mobile applications (“App”), any of our other products and services that link to this Privacy Policy, communicate with customer service, or when you otherwise interact with us, such as through social media. 


We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Website or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.


While this Privacy Policy provides you with information about our privacy practices and certain rights, our Terms and Conditions governs our relationship with you, including your transactions with us and your use of our Website and App.

We collect information directly from you when you apply to join our membership (including information needed to produce a background check report as part of the approval process), sign up for a subscription, place an order, create an account, request customer support, or otherwise communicate with us. The categories of information we collect include:

  • Identification and Contact Information: we collect your name, email address, phone number, birthdate, social media handles, shipping information, and billing information. If you are approved to join our membership, and you create an account with us, we also collect your username and password. 
  • As part of our background check process, we may collect additional information, including any other addresses associated with your name (e.g., past addresses or parents’ addresses) or other names associated with your address, job information, LinkedIn profile, other contact information associated with your name (home phone number or parents’ names), or any other information you may choose to provide. 
  • Communication Information: we collect information included in your communications with us.
  • Financial Information: we engage third party payment processors to collect your payment information. 
  • We may also collect any other information you choose to provide. 

Information We Collect Automatically

We automatically collect the following categories of information:

  • Internet Activity Information: we collect information about how you access our Website and App, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Website and App, as well as interaction with our communications, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Website.
  • Transactional Information: we keep a history of your transactions with us, including the dates and amounts paid.
  • Device and Usage Information: We collect information about how you access our services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our services.
  • Support Information: If you chat with our customer service team, we may monitor and retain those conversations.
  • Precise Geolocation Information: With your consent, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time (see the Your Privacy Choices section below for details).
  • Information Collected by Cookies and Similar Tracking Technologies: We and third-party partners use tracking technologies, such as cookies, pixel tags, SDKs, or similar technologies to collect information about your interactions with our Website, App and communications. For example, we may use pixel tags to recognize and alert you, if you leave items in your shopping cart. These technologies help us improve our Website, App, and communications, see which areas and features of our Website and App are popular, count visits, record information about your browsing session on the Website and App, including which pages you visited and any forms on the Website and App, and track clicks. You may be able to adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Website and App. 

Information We Collect from Other Sources

We may also obtain information from other sources. For example, we may collect information from identity verification services, advertising networks, data analytics providers, mailing list providers, and lead generation providers. The information we collect may include contact and employment information, bankruptcy information, criminal history, mailing or physical address, and email association history. 


We also have a presence on social media platforms, like Facebook, Twitter, and Instagram. The platform providers may share information about your interactions with us on those platforms, 


Customers also sometimes provide us with information about other individuals, such as when a customer sends a gift card or uses a referral code to tell a friend about us. For example, when a customer purchases a gift card for an existing subscriber, we may ask that customer to provide the recipient’s name and email address, and any other information the customer may choose to provide. We will automatically send the recipient email correspondence with the gift card or referral code, and invite them to visit the Website and/or App. By providing such information, you are representing that you have the required permissions and consents to disclose such information.


Derived Information

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address.



USE OF INFORMATION


We use the categories of information we collect for the following business and commercial purposes:

  • Service Delivery: we use information to provide and maintain our Website and App, perform requested services, process payments, review your application, and authenticate your account. For individuals who apply to join our membership, these services include conducting a background check as part of the approval process. 
  • To Verify Your Identity: To verify the identity of our customers as part of the application approval process, we use LexisNexis and Ekata.
  • Communication: we use information to communicate with you about Vivrelle, including to send you newsletters, respond to your questions, inform you of important updates and changes, and send you other transactional or relationship messages.
  • Marketing and Advertising: we use information to send direct marketing messages (including via email and text messages) and target advertisements to you on third-party platforms and websites as described below. You can opt out of direct marketing messages we send by following the instructions in those communications (such as by clicking “unsubscribe” in the emails or replying “STOP,” “END” or “CANCEL” to the texts) or by contacting us.
  • Conducting Analytics: we use information to monitor and analyze Website and App trends, usage, and activities, improve our Website and App, and generate de-identified data. 
  • Promotions: we use information to facilitate contests, sweepstakes, and promotions, as well as to process and deliver entries and rewards. 
  • Protection and Compliance: we use information to detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity, help protect the rights and property of Vivrelle and others, and comply with our legal and financial obligations.


TARGETED ADVERTISING AND ANALYTICS 


We engage others to provide analytics services, serve advertisements, and perform related services. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Website and App, as well as your activities across third-party websites and mobile apps, including your IP address, web browser and mobile network information, pages viewed, time spent on pages, and links clicked. This information is used to deliver advertising targeted to your interests on other companies’ websites or mobile apps and to analyze and track data, determine the popularity of certain content, and better understand your activity.

DISCLOSURE OF INFORMATION

  • Vendors: we disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with background checks and identity verification, fraud prevention, web hosting, payment processing, customer service, analytics, and marketing and advertising.
  • Advertising Partners: We disclose information to third parties for the Marketing and Advertising purposes described above. 
  • Professional Advisors: we disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Legal Authorities: we may disclose information to legal authorities and others for the Protection and Compliance purposes described above, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Vivrelle, our users, the public, or others.
  • Corporate Transactions: we reserve the right to disclose information in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. 
  • Affiliates: we reserve the right to disclose information between and among Vivrelle and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.
  • Consent: we may disclose information when we have your consent or you direct us to do so.

We also disclose de-identified information that cannot reasonably be used to identify you. 



TRANSFER OF INFORMATION

Vivrelle is headquartered in the United States and we have operations and vendors in the United States and other countries. Therefore, we and those that perform work for us may transfer your information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction.

You can review and modify certain account information at any time by logging into your online account.

As described above, Vivrelle uses cookies and similar tracking technologies for various purposes, including to analyze visits to our Website and App, and deliver targeted advertising on the websites or mobile apps of other companies. In addition, most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Website and App.


Location Information

When you first launch any of our mobile apps that collect precise location information, you will be asked to consent to the app’s collection of this information. If you initially consent to our collection of such location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device.


Communications Preferences

You may opt out of receiving text messages or promotional emails from Vivrelle by following the instructions in those communications or by insert other opt-out methods, e.g., managing your communication preferences in your account settings menu. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.


Mobile Push Notifications

With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.


CHILDREN’S PRIVACY 

Vivrelle does not target our products and services to children under 13. If you are a parent or legal guardian and you believe that your child has provided us with personal data without your consent, please contact us at privacy@vivrelle.com.


THIRD PARTY SITES 

Please note that our websites contain links to third-party websites that are not controlled or operated by Vivrelle. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that Vivrelle does not accept any responsibility or liability for these policies. Please review these policies before you disclose any personal data when visiting such third-party websites. In particular, information provided directly to the partners participating in our perks program is subject to the relevant partner’s privacy policy. 



APPLICANT INFORMATION

When you apply for a position with Vivrelle, we collect the information that you provide in connection with your application. This includes name, email address, phone number, current company, professional credentials and skills, educational and work history, other information that may be included in a resume or provided during interviews (which may be recorded), and any other information you may choose to provide (including social media profiles or GitHub/Portfolio links). This may also include demographic or diversity information. We may also conduct background checks and receive related information.


We use applicants’ information to facilitate our recruitment activities and process applications, including evaluating candidates and monitoring recruitment and hiring statistics. We use successful candidates’ information to administer the employment or independent contractor relationship. We may also use and disclose applicants’ information (a) to improve our Website/App, (b) as otherwise necessary to comply with applicable laws, (c) to respond to subpoenas or warrants served on Vivrelle, and (d) to protect and defend the rights or property of Vivrelle or others.
